This website is operated by EverSmall ("we", "us", "our"). By visiting our site and/or purchasing from us, you agree to these Terms of Service ("Terms"), including any policies referenced here (Shipping Policy, Return & Refund Policy and Privacy Policy). If you do not agree, please do not use the site. Our store is hosted on Shopify, which provides the e-commerce platform that lets us sell our products to you.

1. Eligibility

By using this site you confirm that you are at least the age of majority in your state of residence, or that you have given us consent to allow any of your minor dependents to use this site. You may not use our products or site for any illegal or unauthorized purpose.

2. Products

We make every effort to display our products, colors and dimensions as accurately as possible. Because screens differ and the clay imprint depends on each child, the finished keepsake may vary slightly from the images shown. Product photos may include example baby photos and imprints for illustration purposes; photos are not included with your order.

3. Product safety and use

The kit is designed to be used by adults. Always supervise the baby while making imprints, press gently, never leave clay within a child's reach, and wash the baby's hands and feet after use. Do not use the product on broken or irritated skin. Discontinue use if any irritation occurs.

4. Prices and payment

All prices are in U.S. dollars. Prices and promotions may change at any time without notice. We reserve the right to refuse or cancel any order, including orders that appear to be placed by resellers or that contain pricing errors. If an order is cancelled after payment, you will receive a full refund.

5. Accuracy of billing and account information

You agree to provide current, complete and accurate purchase and account information, and to update it promptly when needed so we can complete your transactions and contact you.

6. Shipping, returns and refunds

Shipping is governed by our Shipping Policy, and returns and refunds by our Return & Refund Policy, both of which form part of these Terms.

7. Intellectual property

All content on this site, including text, images, graphics and the EverSmall name and logo, belongs to EverSmall or its licensors and may not be copied or used without our written permission.

8. User comments and reviews

If you submit reviews, photos or comments, you grant us a non-exclusive, royalty-free right to use, reproduce and display them in connection with our store. You agree that your submissions will not be unlawful, offensive or infringe the rights of others.

9. Third-party links and services

Our site may include links or services from third parties (such as payment processors). We are not responsible for their content, policies or practices.

10. Disclaimer of warranties; limitation of liability

Except as expressly stated in our policies, our site and products are provided "as is" and "as available".
